Fire Ordinance #33


AN ORDINANCE REGULATING FIRES WITHIN THE VILLAGE OF ROSCOMMON.


The Village of Roscommon Ordains:


Section 1.  It shall be unlawful for any person to burn in any street, right of way, or public alley within the village limits.

Section 2.  (a) It shall be unlawful to burn articles made of paper anywhere within the village limits, unless such paper articles are within a burner designated for the purpose, consisting of a burner with solid sides and a cover, so that no burning papers may blow to endanger any property from fire. Such burner shall not be used unless it is located at least twenty-five (25) feet from all buildings in every direction.

Further, it shall be unlawful to do any burning permitted under this section except during the hours of 8:00 A.M. to 12:00 P.M. (Noon)
 
Section 2. (b) It shall be unlawful for any person to burn rubbish, garbage, grass, leaves, wood, or wood products within the Village limits of the Village of Roscommon. The exception to this statement is each residential building within the village may have a fire pit. Said pit must be located in the rear yard, at least 15 feet away from buildings in all directions. Fire pit can be no larger than 3 feet in diameter, must be surrounded by a firebreak, and can be used only for burning of firewood. Firewood is defined as natural wood products less than 6 inches in diameter and 3 feet in length.

Section 2. (c) Further, it is unlawful to burn any articles or items or materials, such as tires, which by being burned give off noxious odors or dense smoke from such burning, within the Village limits of the Village of Roscommon.

Section 2. (d) The Village Manager may grant authorization for burning of brush/wood in connection with lot clearing within the Village. Request for this authorization must be received in writing. Written coordination with the Higgins Township Fire Department and the DNR/DEQ for fire control must accompany request for lot clearing burn.

Section 3. It shall be unlawful to store gasoline, or other highly volatile oils in excess of one gallon, above the ground, unless such inflammable liquid be in closed containers and so stored that it may be removed from the premises in case of fire.

Section 4. It shall be unlawful to establish any retail or wholesale oil and gasoline storage station at any place within the village limits except at such locations and in such manner as is approved by the Village Council in writing.

Section 5. It shall be unlawful to allow the accumulation of any inflammable rubbish in any public place or adjacent thereto within the Village.

Section 6. Any person convicted of any violation of any part of this Ordinance shall be punished by a fine not to exceed One Hundred ($100) Dollars, or by imprisonment in the county jail of not to exceed ninety (90) days, or both such fine and imprisonment at the discretion of the Court.

Section 7. Repealing Clause: All ordinances or parts of ordinances in anywise conflicting with the above are hereby modified or repealed as may be necessary to make this ordinance effective.

Section 8. Severability Clause: Should any provision or section of this ordinance be held invalid for any reason, such holding shall not be construed as affecting the validity of the remaining portion of such section of this Ordinance, it being the legislative intent that this Ordinance shall stand, not withstanding the invalidity of any such provision or section.
